Performer Listing & Content Authorization Terms

These Performer Listing & Content Authorization Terms govern performer-profile claims, profile requests, profile updates, photographs, videos, biographies, appearance information, promotional materials, and other content submitted to OUT Local™.

These terms form an agreement between Austin Randall, doing business as OUT Local™ (“OUT Local,” “OUT,” “we,” “us,” or “our”), and the performer or authorized representative submitting information or content (“you” or “your”).

By claiming or requesting a performer profile, submitting content, or selecting the checkbox indicating your agreement, you confirm that you have read and agree to these terms.

1. Your Authority

You confirm that you are at least 18 years old and are:

  • The performer identified in the submission;

  • The performer’s authorized manager, agent, publicist, booking representative, employee, or contractor;

  • A representative of an organization legally authorized to act for the performer; or

  • The parent or legal guardian of a performer who is under 18.

You may not claim, manage, or submit information on behalf of another performer without authorization.

OUT Local may request additional information reasonably necessary to verify your identity, relationship to the performer, or authority to make the submission.

If the performer is under 18, the submission must be made or expressly approved by the performer’s parent or legal guardian.

2. Performer Information Covered

These terms apply to information and materials you submit, upload, send, approve, or authorize in connection with the performer, including:

  • Legal name, when provided for private verification;

  • Stage name, professional name, or public-facing name;

  • Pronouns;

  • Performer category or type;

  • Biography, career information, and professional description;

  • Profile photographs, headshots, and performance photographs;

  • Videos, audio clips, interviews, and promotional reels;

  • Voice, image, photograph, and likeness;

  • Logos, symbols, artwork, and personal branding;

  • Social-media usernames and links;

  • Website, booking link, and public contact information;

  • Public booking email or management information;

  • Venue affiliations and recurring appearances;

  • Event names, dates, times, locations, and ticket links;

  • Promotional flyers, posters, and event graphics;

  • Awards, titles, credits, and professional accomplishments;

  • Quotes, captions, or statements submitted for publication;

  • Corrections and updates to an existing profile; and

  • Other materials provided in connection with the performer.

These materials are referred to collectively as the “Submitted Content.”

3. Legal Name and Private Verification Information

A legal name requested for verification will not be displayed publicly unless you expressly request or authorize its publication.

OUT Local may use a legal name, private email address, telephone number, or other verification information to:

  • Confirm the performer’s identity;

  • Review a profile claim;

  • Prevent impersonation or unauthorized access;

  • Communicate about the submission;

  • Resolve ownership or authorization disputes; or

  • Comply with legal obligations.

Private verification information will be handled according to the OUT Local Privacy Policy.

4. Permission to Create and Display a Performer Profile

You authorize OUT Local to create, maintain, publish, display, organize, and promote a profile for the performer through the OUT Local website, mobile application, emails, social-media accounts, presentations, advertising, launch materials, and related services.

You authorize OUT Local to associate the performer with relevant:

  • Events;

  • Venues;

  • Cities and neighborhoods;

  • Performer categories;

  • Search results;

  • Recommendations;

  • Calendars;

  • Collections;

  • Editorial features; and

  • Discovery tools.

The performer’s public profile may include information submitted by you and factual information obtained from lawful public sources.

5. License to Submitted Content

You retain any ownership rights that you or the performer hold in the Submitted Content.

You grant OUT Local a non-exclusive, worldwide, royalty-free license to:

  • Host and store the Submitted Content;

  • Reproduce, publish, display, and distribute it;

  • Resize, crop, compress, format, or convert it;

  • Edit written content for spelling, grammar, clarity, style, length, and formatting;

  • Create thumbnails, previews, excerpts, captions, and promotional layouts;

  • Include it in performer, venue, and event listings;

  • Include it in recommendations, calendars, maps, emails, presentations, advertisements, and social-media content;

  • Promote the performer and their appearances;

  • Promote OUT Local and the people, events, venues, and communities featured through it; and

  • Permit OUT Local’s contractors and service providers to process the content as reasonably necessary to perform these activities.

This license is limited to operating, maintaining, developing, publicizing, and promoting OUT Local and the performers, events, venues, and community resources featured through the Service.

Submitting content does not transfer ownership of that content to OUT Local.

6. Name, Stage Name, Voice, Image, and Likeness

You authorize OUT Local to use the performer’s approved:

  • Name;

  • Stage name;

  • Professional identity;

  • Photograph;

  • Image;

  • Voice;

  • Likeness;

  • Biography;

  • Pronouns;

  • Public statements; and

  • Professional information

for the purposes described in these terms.

This permission includes using the performer’s name and likeness to identify and promote:

  • Their performer profile;

  • Their scheduled appearances;

  • Events in which they participate;

  • Venues where they appear;

  • Editorial or discovery content featuring them;

  • OUT Local’s platform and features; and

  • OUT Local launch or promotional campaigns.

Georgia courts have recognized that appropriating another person’s name or likeness without consent for financial gain may support a right-of-publicity claim. This authorization is intended to document the performer’s consent for the uses specifically described here.

7. Limits on Name and Likeness Use

Unless you separately agree in writing, these terms do not authorize OUT Local to:

  • Create or sell merchandise bearing the performer’s name or likeness;

  • License the performer’s identity to an unrelated third party as a standalone commercial asset;

  • State that the performer endorses a political candidate, cause, product, or third-party service;

  • Create a materially deceptive synthetic version of the performer’s image or voice;

  • Use the performer’s identity in pornography or sexually explicit advertising;

  • Falsely represent the performer’s views, statements, affiliations, or conduct; or

  • Enter into contracts or commitments on behalf of the performer.

OUT Local may include the performer in advertisements that promote OUT Local, their profile, their events, participating venues, or the Service generally.

The performer’s inclusion in an OUT Local promotion does not, by itself, mean the performer endorses an unrelated advertiser or sponsor.

8. Photographs and Videos

You authorize OUT Local to use submitted or approved photographs and videos for:

  • Performer profiles;

  • Event and venue listings;

  • Search results;

  • Recommendations;

  • Website and app previews;

  • Emails and newsletters;

  • Social-media posts;

  • Partner presentations;

  • Launch campaigns;

  • Digital advertisements; and

  • Other materials reasonably related to OUT Local.

OUT Local may crop, resize, compress, caption, format, or make other reasonable technical or editorial adjustments.

OUT Local will not intentionally alter an image or video in a way that materially misrepresents the performer or the event depicted.

9. Photographer and Creator Permissions

You confirm that you own the Submitted Content or have sufficient permission from each applicable rights holder to provide it to OUT Local for the uses described in these terms.

Necessary permissions may include permission from:

  • Photographers;

  • Videographers;

  • Graphic designers;

  • Illustrators;

  • Makeup artists or stylists with applicable contractual rights;

  • Production companies;

  • Venues;

  • Event organizers;

  • Promoters;

  • Record labels;

  • Music publishers;

  • Copyright owners;

  • Trademark owners; and

  • Other creators or rights holders.

The person who takes a photograph generally owns its copyright unless ownership has been transferred or another ownership rule, such as work made for hire, applies. Possessing a copy of a photograph or being the person depicted does not necessarily make the performer its copyright owner.

Do not submit an image, video, flyer, recording, or design when you are uncertain whether you have sufficient permission.

10. Music, Recordings, and Performance Footage

Do not submit music, sound recordings, music videos, performance footage, or clips containing copyrighted music unless you have sufficient authorization for OUT Local to use that material as described in these terms.

Permission from the performer shown in a video may not include permission from:

  • The songwriter;

  • Music publisher;

  • Recording artist;

  • Record label;

  • Sound-recording owner;

  • Videographer;

  • Event producer; or

  • Venue.

Copyright owners hold specific rights to reproduce, adapt, distribute, publicly display, and, for certain works, publicly perform protected material.

OUT Local may mute, replace, shorten, decline, or remove audio or video when necessary to address rights, technical, or platform-policy concerns.

11. Other People Appearing in Submitted Content

You confirm that you have any permission reasonably necessary to provide content depicting identifiable dancers, hosts, audience members, collaborators, employees, photographers, or other individuals.

Do not submit:

  • Nonconsensual intimate imagery;

  • Images taken in spaces where someone reasonably expects privacy;

  • Images intended to expose, shame, or endanger someone;

  • Private messages or personal information without authorization;

  • Images of an incapacitated person submitted to humiliate or exploit them;

  • Misleadingly edited images;

  • Sexualized content involving anyone under 18; or

  • Content that otherwise violates the OUT Local Community Guidelines.

OUT Local may reject or remove content when its use may create a privacy, safety, consent, or intellectual-property concern.

12. Events and Appearance Information

You confirm that appearance information submitted for the performer is accurate to the best of your knowledge.

This includes:

  • Event name;

  • Date and time;

  • Venue;

  • City and location;

  • Ticket or reservation link;

  • Admission price;

  • Age restriction;

  • Performer lineup;

  • Hosting or performance role; and

  • Cancellation or schedule information.

You agree to notify OUT Local within a reasonable period if an appearance is canceled, postponed, relocated, rescheduled, or materially changed.

OUT Local may also obtain or confirm appearance details through public venue calendars, ticketing pages, event organizers, promoters, or the performer’s public professional accounts.

13. Biography, Credits, and Professional Information

You confirm that biographies, awards, titles, credits, affiliations, and professional claims submitted through the form are accurate to the best of your knowledge.

You agree not to submit:

  • Awards or titles the performer did not receive;

  • Venues or events where the performer did not appear;

  • False representation or management relationships;

  • Misleading claims of sponsorship or endorsement;

  • Materially inaccurate biographical information; or

  • Another person’s biography copied without authorization.

OUT Local may shorten or reformat a biography while attempting to preserve its meaning.

14. Social Media and Booking Information

You authorize OUT Local to display the performer’s approved public:

  • Social-media usernames;

  • Website;

  • Booking link;

  • Public booking email;

  • Management or agency contact; and

  • Ticketing links.

Do not provide a private telephone number, home address, personal email, or other information you do not want displayed publicly.

OUT Local may contact the performer or authorized representative through private contact information supplied for verification, support, or profile management.

15. Publicly Available Information

OUT Local may maintain an informational performer profile using factual information available from lawful public sources, even if no claim has been submitted.

Public sources may include:

  • The performer’s public website;

  • Public professional social-media accounts;

  • Venue calendars;

  • Event flyers;

  • Ticketing platforms;

  • Published interviews;

  • Event-organizer announcements; and

  • Other public event information.

These authorization terms govern content submitted or expressly approved through the performer-claim process. They do not limit OUT Local’s ability to use facts, materials, or information when another lawful basis or separate authorization applies.

A performer may request correction, review, claim, or removal of a profile through the applicable OUT Local process.

16. Profile Verification and Management

Submission of a claim does not automatically result in verification or management access.

OUT Local may request:

  • Confirmation through an official social-media account;

  • Confirmation through a public booking email;

  • Identification of a management or agency relationship;

  • Additional information about the performer;

  • Confirmation from the performer; or

  • Other reasonable evidence of authorization.

OUT Local may reject, revoke, or transfer profile access when it reasonably believes that:

  • A claim was unauthorized;

  • Information supplied was false;

  • The performer requested a change;

  • An agent or management relationship ended;

  • The account presents a security risk; or

  • Access would violate another person’s rights.

17. Editing and Formatting

OUT Local may edit Submitted Content for:

  • Grammar and spelling;

  • Clarity;

  • Length;

  • Formatting;

  • Search and categorization;

  • Accessibility;

  • Consistency with other profiles;

  • Removal of duplicative content; and

  • Compliance with applicable policies.

OUT Local may select which submitted images or information appear on a profile.

We will not knowingly make a material factual alteration that misrepresents the performer.

You may request a correction by emailing hello@outlocal.com.

18. Publication and Promotion Are Not Guaranteed

Submitting or claiming a performer profile does not guarantee:

  • Verification;

  • Publication;

  • Continued publication;

  • Featured placement;

  • Inclusion in recommendations;

  • Promotion through social media or email;

  • Inclusion in a launch campaign;

  • Acceptance into a founding-performer program;

  • Bookings;

  • Ticket sales;

  • Audience growth;

  • Revenue; or

  • Any particular business result.

OUT Local may decline, delay, edit, archive, restrict, or remove a profile or Submitted Content, subject to applicable law.

19. Standard Profile Claims

Unless otherwise disclosed, OUT Local does not charge a fee to submit a standard performer claim or request a basic performer profile.

Advertising, sponsored placement, featured profiles, promotional campaigns, subscriptions, ticketing services, or other commercial services may be subject to separate written terms and charges.

Accepting these terms does not require the performer to purchase a paid service.

20. No Compensation or Royalties

Unless OUT Local agrees otherwise in a separate written agreement, neither you nor the performer will receive compensation, royalties, license fees, residuals, or other payment for OUT Local’s authorized use of the Submitted Content.

The performer remains free to use, license, publish, or authorize their content elsewhere.

The license granted to OUT Local is non-exclusive.

21. Removal and Withdrawal Requests

The performer or an authorized representative may request that OUT Local:

  • Correct profile information;

  • Remove or replace a photograph or video;

  • Update social-media or booking information;

  • Remove outdated appearance information;

  • Revoke another representative’s profile access;

  • Withdraw claimed-profile status; or

  • Review removal of a performer profile.

Requests may be sent to hello@outlocal.com or submitted through the Manage Your Data page.

OUT Local may require verification of the requester’s identity or authority.

After confirming a valid request, OUT Local will make reasonable efforts to stop future use of the applicable Submitted Content within a reasonable processing period.

A withdrawal request may not require OUT Local to:

  • Recall emails already delivered;

  • Recall printed materials already distributed;

  • Delete archived legal, security, or authorization records;

  • Alter completed presentations or reports;

  • Immediately remove data from temporary backups;

  • Control copies independently shared or stored by third parties; or

  • Remove content that OUT Local has another lawful right or authorization to use.

22. Copyright, Likeness, and Other Complaints

Copyright complaints should be submitted according to the OUT Local Copyright & DMCA Policy.

Concerns involving:

  • Unauthorized use of a name or likeness;

  • Impersonation;

  • Privacy;

  • Trademark rights;

  • False affiliation;

  • Unauthorized profile claims;

  • Incorrect information; or

  • Another legal or policy issue

may be sent to hello@outlocal.com.

Include the specific profile or content involved, a description of the concern, your relationship to the performer or rights holder, and any supporting information.

23. Your Representations

By submitting content, you represent and confirm that:

  • You have authority to accept these terms;

  • You are the performer or are authorized to act for the performer;

  • The information supplied is accurate to the best of your knowledge;

  • You own or have sufficient permission to provide the Submitted Content;

  • OUT Local’s authorized use will not knowingly violate another person’s copyright, trademark, privacy, publicity, contractual, or other rights;

  • You have obtained any permissions needed from photographers, videographers, designers, collaborators, venues, promoters, and other identifiable people;

  • The submission does not contain unlawful, defamatory, deceptive, or malicious material;

  • The submission complies with the OUT Local Terms of Use and Community Guidelines; and

  • You will notify OUT Local if these statements are no longer accurate.

24. Responsibility for Claims

You are responsible for the information and content submitted through your claim.

To the fullest extent permitted by law, you agree to reimburse and protect OUT Local, its owner, contractors, service providers, employees, and representatives from third-party claims, losses, liabilities, costs, and reasonable legal fees arising from:

  • A material breach of these terms;

  • A false claim of authority;

  • Submitted Content that infringes another person’s rights;

  • Missing permission from a photographer, videographer, designer, collaborator, venue, promoter, or other rights holder;

  • Materially false or misleading performer or event information; or

  • Unlawful content submitted by you.

This obligation does not apply to a claim caused solely by OUT Local’s use of content outside the authorization granted by these terms.

25. No Agency, Representation, or Endorsement

A performer profile or approved claim does not, by itself, create:

  • An employment relationship;

  • A management or talent-representation relationship;

  • An agency relationship;

  • A legal partnership;

  • A joint venture;

  • An exclusive relationship;

  • An ownership interest;

  • A booking guarantee;

  • A sponsorship; or

  • A formal endorsement.

OUT Local is not authorized to negotiate or accept bookings on behalf of the performer unless the parties enter into a separate written agreement.

Neither party may enter into contracts or make legal commitments on behalf of the other without separate authorization.

26. Relationship to Other OUT Local Policies

Use of OUT Local is also governed by the:

  • Terms of Use;

  • Privacy Policy;

  • Community Guidelines;

  • Copyright & DMCA Policy;

  • Manage Your Data process; and

  • Any separate advertising, sponsorship, subscription, ticketing, or partner agreement that applies.

If these terms conflict with the general Terms of Use regarding a performer submission, these more specific Performer Listing & Content Authorization Terms will govern that submission.

27. Term and Continuing Provisions

These terms apply beginning when you submit a profile claim or Submitted Content.

The authorization continues until the applicable content is removed, permission is withdrawn, or OUT Local no longer needs the content for an authorized purpose.

Sections regarding ownership, previously authorized use, representations, third-party claims, completed materials, dispute terms, and retained records may continue after withdrawal where reasonably necessary.

28. Changes to These Terms

OUT Local may update these terms to reflect changes in the Service, submission process, content practices, or legal obligations.

The revised version will display an updated date.

Material changes will apply prospectively unless additional notice or consent is required.

29. Governing Law

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute that may be brought in court will be subject to the jurisdiction provisions contained in the OUT Local Terms of Use.

30. Electronic Agreement

Selecting an agreement checkbox, submitting a performer claim, uploading Submitted Content, or otherwise electronically indicating agreement constitutes acceptance of these terms.

You should save a copy for your records.
